Unlike most law firms, Balestriere Fariello is willing to share the risk
with clients in litigation. We do not get paid simply for effort. We get
paid for the value we obtain for our clients.
In our private commercial, financial, and business litigation
we are NOT paid by the hour, but instead, work on a blended conditional
fee basis. This means we get paid a monthly retainer but receive most of our fees, if any, based on the result
we obtain for our client and credit any monthly fees toward the conditional fee or success premium we earn.
If we represent plaintiffs, we obtain
a percentage of the financial recovery. If we represent defendants,
we devise a system of bench marks (including a so-called reverse
contingency depending on the agreed upon client exposure), only
being paid if we meet certain bench marks.
We do not seek to slow down litigation or grind the adversary down, as do most defense firms. We want to push our cases to a speedy and fruitful conclusion.
Because we are paid this way, our financial incentive is aligned with our
clients'. We only get paid and win if the client gets paid and wins.
